Doctor Hurlbut's appeal

I, Doct P Hurlbut, having been tried before the Bishops council of High Priests in a charge of Unchristian like conduct with the female Sex, and myself being absent at the time and considering that Strict justice was not done me. I do by these presents most solemly enter my appeal unto the Presidents council of high priests for a re hearing according to the privilige garranteed to me in the laws of the church which council is now assembled in the school room in Kirtland the 21st June 1833.

  Original: Hurlbert

term: bishop's council of high priests

term: president's council of high priests

Rehearing granted   Re-hearing is moved, seconded, and carried.
Open   Joseph opens with prayer.
Ordain two to make twelve   Sidney ordains John and William Smith high priests to make twelve "that the council or <church> court might be organized."   church court: probably anachronistic usage.

John: Probably "Uncle" John Smith (1781–1854), brother of Joseph Sr., who had arrived in Kirtland in May. Uncle John became a charter member of the Kirtland high council on February 17, 1834.
Merits excommunication, but confesses and is restored   Orson Hyde and Hyrum present testimony against Doctor. He is found guilty and deserves to be cut off, but due to his "liberal confession," he is restored.   At age 15, George A. Smith attends the council. He later reports that Joseph told the council Doctor was not honest and would not fulfill his promise. Shortly thereafter, Hurlbut told the Thompson, Ohio, branch that he deceived Joseph, "I told them I was sorry I confessed and they believed it to be an honest confession," ¶ Satan Came Also
    [signed] Joseph Smith Jr.
One excommunicated for not filling mission   The "President's Court" takes Daniel Copley's priest's license and membership for refusing to fulfill his mission "according to the council of the High Priesthood of the holy order of God."   "The young man said he was too weak to attempt to preach, and the Council cut him off the Church. I wonder what our missionaries now would think of so rigid a discipline as was given at that time thirty one years ago, under the immediate supervision of the Prophet." Ibid.
